Earlham City Council Meeting

August 10, 2015


The Earlham City Council met in regular session on Monday, August 10, 2015, 7:00 p.m., at Earlham City Hall. Mayor Dusky Terry called the meeting and the following answered roll: Lillie, Royster, Petersen, Swalla. Staff present: Clerk Hibbs, Public Works Supervisor Coffman, Police Chief Heimdal.

  1. Approval of Agenda
    • Motion by Royster, seconded by Lillie to approve agenda
    • Roll: Ayes – unanimous. Motion passes.

    • Stancil arrived at 7:01.
  2. Public Hearing on Status of Project Activities for the CDBG for the 2015 Water Main Improvement Project Jeremy Rounds from SICOG read a statement regarding the project. No comments from public. Hibbs stated no written or oral comments were received at city hall. Coffman stated he had spoken with a couple of residents and he was able to answer their question and/or addressed their concerns. He also stated all the mains are in ground and have passed testing. Nine houses have been connected.

    • Minutes of July 13, 2015 regular Council meeting
    • June 2015 Treasurer’s report
    • July 2015 Treasurer’s report
    • August 2015 Claim and Receipt report
    • Drawdown #3 for CDBG Water Main Replacement Project for $58,466.00
    • Hibbs explained that due to the new computer being installed, and the software delays which occurred, she was not able to have the June 2015 and July 2015 Treasurer’s Reports, or the claims and receipts report available for the meeting.
    • Motion by Royster, seconded by Stancil to approve items a. and e. of the consent agenda.
    • Roll: Ayes – unanimous. Motion passes.
    • Items b, c, and d will be considered for approval at the special council meeting on August 21, 2015.
  5. Public Works Report, Gary Coffman, Public Works Supervisor
    • Coffman stated regular seasonal work was ongoing including mowing, trimming, pool, and spraying. He noted the grate had been removed at Chestnut Avenue north of 6th Street. Discussion on the need for some type of fence for safety purposes.
  6. Boards, Commission, Committee Reports - None
  7. Police report, Police Chief Jason Heimdal
    • Heimdal reported there had been some repair/maintenance items on squad cars. Gave tour of police office to group from Young Explorers where they also talked about bike safety. Stated there have been concerns about safety issues surrounding outside archery in town. He noted the code allows archery on private property, however he recommends a change. Council set Friday, August 21, 2015 at 6:00 for a Public Safety Committee meeting. Swalla asked about a particular residence where a large tree limb was still in the yard from the storm last month. Heimdal said he would follow through on nuisance abatement.
    • Consider approval of Second Reading of Ordinance No. 374, Amending the Code of Ordinances of Earlham, Iowa, 2007, Chapter 66.05 Truck Route.
      • Motion by Stancil, seconded by Lillie, to approve the Second Reading of Ordinance No. 374, Amending the Code of Ordinances of Earlham, Iowa, 2007, Chapter 66.05 Truck Route
      • Roll: Ayes – unanimous. Motion passes.
    • Consider approval of Drawdown #3 for CDBG Housing Rehabilitation Project for $1462.00 Stancil asked if the house #2 issue, where they wanted to add some items to the list, had been resolved. Rounds said he would have Becky Nardy email the council on house #2.
      • Motion by Royster, seconded by Swalla, to approve Drawdown #3 for CDBG Housing Rehabilitation Project for $1462.00
      • Roll: Royster -aye, Swalla-aye, Petersen-aye, Lillie-aye, Stancil-nay. Motion passes.
    • Consider approval of RFP for annual exam from Faller, Kincheloe & Co, PLC Stancil suggested doing a full RFP for these service. It was decided to get quote from the State Auditor’s Office as well as one other firm would be sufficient. Hibbs will obtain those bids. This item is tabled to next month’s meeting.
  10. Mayor’s Report
    • Mayor gave update on Arnburg vs. Board of Adjustment, stating neither side appealed the decision. He noted we haven’t heard anything lately from the Farmers Co-Op. Stated we should reach out to them and find out what their plans are. He also stated the Planning & Zoning Commission has one seat open. Trish Toma resigned from the Community Center Board so there is one opening there. He mentioned the opening night of the summer concert series was well attended. He reminded council that elections will be held November 3, 2015. The mayor and two council seats will open.
  11. Clerk’s Report
    • Further discussion of Chapters 90-93 Earlham Code of Ordinance – this will be discussed at the Municipal Enterprise Committee meeting. Hibbs stated Steve Marsh from IAMU came to get information for the water/sewer rate study. Because of computer issues, Hibbs was unable to provide that information, but as soon as those issues are addressed she will get that to him.

  13. Adjourn – being there was not further business, the meeting was adjourned at 7:50 p.m.
    • The next regularly scheduled meeting will be held September 14, 2015 at 7:00 p.m.
    • A Special Session, along with Public Safety Committee and Municipal Enterprise Committee meeting, will be held on August 21, 2015 at 6:00 p.m.
