Earlham City Council Meeting

October 12, 2015

The Earlham City Council met in regular session on Monday, October 12, 2015, 7:00 p.m., at Earlham City Hall. Mayor Dusky Terry called the meeting to order at 7:00 p.m. and the following answered roll: Lillie, Petersen, Royster, Stancil. Swalla arrived at 7:02 p.m. Staff present: Clerk Hibbs, Public Works Supervisor Coffman, Police Chief Heimdal. Also in attendance, Michael Anthony of Shive-Hattery.

  1. Approve Agenda
    • Motion by Royster, seconded by Lillie, to approve agenda.
    • Roll: Ayes – unanimous. Motion passes.
  2. Public Forum
    • Stephanie Bakalar, 155 NW Walnut Ave., presented a complaint regarding the removal of trees in the parking on the north side of her property. She stated one was dead, but the other was still alive, and she would like to have that tree replaced. Coffman stated he has replacement trees, but he will not put it on the parking, but rather on the other side of the sidewalk. Mike Golightly, 105 NW Elm Ave, expressed a complaint about barking dogs across the street from him. Mayor advised him to call Madison County Sheriff’s Office when the nuisance is occurring, so an Earlham police officer can be dispatched to check on this.
  3. Consent Agenda:
    • Minutes of September 14, 2015 regular session Council meeting
    • September 2015 Treasurer’s report
    • September 2015 Claim and Receipt report
    • Consideration of Mayor’s appointment of Denise Rasmussen to the Community Center Board.
    • Stancil requested 3rd item be removed from Consent Agenda.
      • Motion by Petersen, seconded by Stancil to approve the amended consent agenda, 1st, 2nd & 4th items
      • Roll: Ayes – unanimous. Motion passes.

    • Stancil had a question regarding several items on the Claims and Receipt report which were answered by Hibbs and Coffman.
      • Motion by Stancil, seconded by Royster, to approve the 3rd item of the consent agenda
      • Roll: Ayes – unanimous. Motion passes.
  4. Public Works Report, Gary Coffman, Public Works Supervisor
    • Coffman presented long list of items completed this fall including fence repair, ball fields, hydrants flushed, valves turned, street seal-coating and repair work, rocking of alleys, placing of “No Parking” and “25mph” signs, and weed spraying. He reported Rich Farrell has resigned and we are currently advertising for Public Works Employee 3. Mike Anthony from Shive Hattery, presented the findings from the speed pads which were placed on Walnut Street at the south city limit. The data will be sent to council members and discussed at the next Public Safety Committee meeting. Coffman answered Council questions on the recent DNR Public Water Supply Sanitary Survey.
  5. Boards, Commission, Committee Reports
    • The Municipal Enterprise Committee meeting is scheduled for Tuesday October 27, 2015, at 7:00 p.m. The water/sewer rate study will be discussed at that time. The Public Safety Committee will hold a public hearing on Monday, October, 26, 2015 at 6:30 p.m. on a proposal to ban archery in city limits, Their regular committee meeting will be held immediately following the public hearing.
  6. Police report, Police Chief Jason Heimdal
    • Chief Heimdal reported Homecoming was held last month with no incidents. He assisted in a drunk driving presentation that week at the High School. He has been working with City Attorney Braland on amending our animal ordinances. These will be ready for review at the Public Safety Committee meeting.
  7. OLD BUSINESS – None
  8. NEW BUSINESS
    • Consider approval of First Reading of Ordinance No. 375, Amending Chapter 116 Cemetery of the Earlham Code of Ordinances. Hibbs presented Ordinance No. 375, which council had not yet seen. She explained changes to the current Chapter 116 are mandated by recent Compliance Examination of the Earlham Cemetery performed by Iowa Insurance Division. A discussion followed on the Cemetery Perpetual Care Fund. It was decided before approval, Municipal Enterprise Committee will review it at their next meeting.
    • Consider approval Resolution No.15-24 Setting Wages for Library Employees Effective July 1, 2015. Hibbs explained this Resolution should have been done following the July Library Board Meeting.
      • Motion by Royster, seconded by Stancil, to approve Resolution No. 15-24 Setting Wages for Library Employees Effective July 1, 2015.
      • Roll: Ayes – unanimous. Motion passes.
    • Consider approval of Resolution No. 15-25 Approving the 2015 Street Finance Report
      • Motion by Petersen, seconded by Lillie, to approve Resolution No. 15-25 Approving the 2015 Street Finance Report.
      • Roll: Ayes – unanimous. Motion passes.
    • Consider approval of Resolution No. 15-26, to Recognize and Welcome Earlham Family Dentistry as a New Business in the City of Earlham, Iowa. Stancil requested the third “Whereas” of the resolution be struck.
      • Motion by Stancil, seconded by Petersen to approve Resolution No. 15-26 to Recognize and Welcome Earlham Family Dentistry as a New Business in the City of Earlham, Iowa, as amended.
      • Roll: Ayes – unanimous. Motion passes.
    • Consider approval of Certificate of Interment Rights for Earlham Cemetery. Hibbs stated this takes place of the current “deed” and is mandated by the Iowa Insurance Division. The Municipal Enterprise Committee will review this at their next meeting.
  9. Mayor’s Report – Mayor stated another Library Board Member is still needed. He also addressed vandalism, including a recent incident at the new City Stage. Discussion followed.
  10. Clerk’s Report – Hibbs explained the Revenue and Expenses reports that council will be receiving monthly. This is per auditors at the recent annual exam. She also stated the annual examination went well, with several suggestions given by the auditors.
  11. Council comments/discussion – Lillie inquired as to the status of the rebate checks for the LED lights. Hibbs stated they have come in.
  12. Adjourn – Being there was no further business the meeting was adjourned at 8:19 p.m.
